Big questions for SDSU and BSU as league dissolves - Mountain West Connection
Should Boise and SDSU still pay an exit penalty when every team is leaving the Mountain West and the conference will cease to exist by the time they leave?

if they leave in 2012 then yes as it is still the Mountain West. If they leave in 2013 though things get interesting.

Although I believe Boise State voted in favor of the merger. As an unfortunate result, we should still pay some sort of exit fee.

The fact that they are dissolving before the merger,
gives BSU leverage. Without other factors, which I think support what I’m about to say, the Broncos, if they leave in 13’ should not pay an exit fee.
A. When BSU officially leaves to the Big East, the MWC will have been dissolved in order to form the new merged conference. This means that the MWC whom BSU made their agreements with will cease to exist. Therefore making their agreement null & void.
“Citing college football industry sources, McMurphy writes that "[t]he reason that the institutions are dissolving and forming their own league is for legal reasons." What those legal reasons are was not detailed”.
B. For whatever reasons legally (To protect themselves) they made the decision to dissolve, and in business that sword cuts both ways. Generally, an entity dissolves so as not to incumber the new business with any liabilities. Fortunately, for BSU, that also includes negating future income also. Oops sorry MWC.
C. This is out side of the above, but IMO, any lawyer could tie the MWC up in court long enough for them to say “the heck with it, we’re losing money on the TV deals we’re trying to get with the new conference, that we can’t, but need to dissolve first for, just to fight for something we might not win.”
C.1. The MWC, BSU signed up for, ended up not existing.
C.2. The MWC/USA merger we voted for is not going to exist either, with, or without us.
C. 3. The part that amazes me is, nobody points out the obvious. BSU’s benefit to signing the contract with the MWC was an obvious improvement in SOS. That benefit went away, which in itself is a breach of the contract. In any contract there has to be benefits to both parties, and when one side gets their benefit, and the other doesn’t. its reason enough to file for a breach of contract. Its not like the Big East, who has had agreements with those teams for awhile, & now their bolting for greener pastures.
They’ve had their Orange Bowls & Fiesta’s ect, ect…There is a reason for the fines, and we suffered the consequences, but even there the MWC benefited(exit fees payed). BSU however, still no AQ, and still no SOS. Its obvious, and its only getting worse with the merger. Where’s the BSU benefit? Nowhere. I believe a judge would see that we have a good reason for leaving the MWC. As an entity, their a bunch of flakes.
So, NO. BSU should legally tell them to take their exit fees and shove it.

if BSU and SDSU go in 2013, don’t they just forfeit the media revenue for the 2012 season? If so then we would still owe since the MWC will still be a functional legal entity/conference for the 2012 season.

Here’s the Air Forces take on it;
Air Force Falcon athletic direct Hans Mueh has come out and said that if Air Force goes to the Big East they will not be paying the $5 million exit fee for leaving the Mountain West. The exit fee was set up back on June 7 when Utah and BYU left the league and here are the exact details of what teams would forfeit if they leave the Mountain West:
Effective this date, the Mountain West has added to its Bylaws resignation parameters which establish a significant financial penalty for an institution that chooses to depart the Conference. If a member institution provides notice on or before the June 30 preceding its subsequent June 30 withdrawal date, it shall forfeit its final year of revenue. If the resigning member gives notice after the established June 30 notice date, it shall forfeit its final year of revenue plus pay a sum of $5,000,000 OR shall pay double the amount of the final year’s revenue, whichever is greater.
What Mueh is saying is that at this time Air Force would rather wait a year and join the Big East in 2013-14 and forfeit their revenue from the Mountain West television deal instead of paying the $5 million exit penalty for making a move after the June 30 deadline. The amount of revenue for the Mountain West television deal is just under $2 million so if Air Force can wait to make the expected move to the Big East then the will.
