KTVB and BSU battle over live broadcast
great. more dumb stuff. but, really, it doesn't have a whole lot to do with the First Amendment issue. It isn't government telling what KTVB could or could not release. just the timing and whether or not to do it live. i support BSU in this, but the way it was executed was VERY poor.

Also, on KTIK, Caves and Murphy talked about it.
Caves said that once it was no longer live, stations can rebroadcast, edit, etc, as needed. but that the sticking point was that it was live.
wow. this certainly isn’t BSU’s (administration-wise) year.

This is Not a BSU Issue...at least directly anyway
Learfield Sports holds the “broadcast rights” to all athletics related events (games, press conferences, special broadcasts) at BSU. They get to decide what can and cannot be broadcast live by entities (KTVB, KTIK, blahblahblah) outside of BroncoSports Properties. Everyone knew this and played by the rules…except for the arrogant doorknobs over on Fairview. What’s worse is that they sent Baby Faced Larrondo to scream “First Amendment” when their “live shot” was icksnayed by BSU/Learfield.
DUMB, with a capital DUMB, move by KTVB.
This is how things work at major college programs across the country.

I think he was KTIK’s puppet. They knew they weren’t supposed to broadcast it live, but they wanted to protest it. Not with one of their established “talents”, but by throwing the new guy under the bus. Though if you’re going to throw somebody under a bus, who better than a Vandal?!

I did go to that law school, and can confirm that no !st Amendment issues would be implicated in this situation

Something important to note here....
During the protest, Ryan said “Freedom of Speech.” While still a part of the 1st Amendment argument, his speech was not being impeded in any way. I think what he was trying to invoke is the freedom of the press. However that’s a very hard argument to prove considering we’re all allowed to use the material in whatever way we see fit. I understand Ryan was in a tough spot. He was merely carrying out the directives of his bosses. But we were all told very clearly on multiple occassions that what KTVB was atempting to do is a strict “no-no.”
Let me put it this way. Learfield owns the rights to all BSU sports related broadcast content. They provide the live feed to www.broncosports.com. No other media outlet is allowed to infringe upon that broadcast. So look at this example. Learfield has an agreement with KTVB they are the exclusive broadcaster of the games Learfield has the rights to. That means my station may not set up our own broadcast of the games ourselves. It’s the rules we all play be, and apparently they don’t feel those rules should apply to them.
Ballsy, but not a very prudent play.

Yeah, this whole scenario is interesting.
We already made a big push the last time around. From what I understand it was Boise State that preferred KTVB, and let Learfield know. But it’s not surprising. They’ve had a long standing relationship, and it’s hard to go a new direction when you’re comfortable with the one you already have in place. I mean, take for instance Bob Kustra’s appearing on KTVB over the weekend and discussing the “inebriated” and “nasty” comments. I asked repeatedly for an opportunity to speak with the BSU president about it, and was told every time that he wasn’t discussing the matter any further. Access is paramount in this business, and when your denied it things get more complicated. I digressed a bit, but I wouldn’t expect to see Boise State in conjunction with Learfield look to change their broadcasting partnership when they’re plenty comfortable with the one they already have.

Boise State sent a memo to the media saying they will not allow live broadcast this year. So this is KTVB’s fault and they better back off or next time Boise State need to sign a local media contract, they might feel that they should go with someone else.
I am the BSU Guru. I know everything and anything about BSU, just ask me. Although I may need a minuteā¦and an internet connection.

When Lane Kiffin announced his move to USC there was a big issue about news stations who wanted to televise it live but Tennessee wouldn’t let them. I saw the footage after the fact and the university wouldn’t allow it. It was actually a pretty heated situation.
I think news stations have only their interests and numbers in mind and use the first amendment right as an excuse to get around the university.
I’m no lawyer, but if I want to say something and you want to hear it then I would think you are on my terms.

The First Amendment only applies to what people say and censorship of what they say (or in this case reports report on) by the governement. It has nothing to do with broadcast rights.

Although I sure do think that he sounded a little bit uncomfortable taking his stand. Guess that’s what happens when you’re the new guy.
I just don’t think KTVB sports can get any worse for me right now. Call me sexist, but we have to tolerate all of those women commentators who are only there because they’re nice to look at (by the way, I still don’t believe you boys are THAT shallow). Why the heck can’t us girl sports fans have some eye candy too? Name me one hot male sportscaster! Can’t do it, can you? OK – Aikman still does it for me, but name me one EVERY DAY guy.

Here's the Lane Kiffin presser fiasco if you're interested.
It’s a slightly different situation than yours, but fun nonetheless. That was a brutal night to be in Knoxville.
The players are: Bud Ford is the guy in the sweater who obsessively taps the paper to the desk. He’s the UT media director.
I forget the name of the balding guy standing next to him, but he’s from the TV station that had a problem with the arrangement.
Chris Low of ESPN is the big guy who sits down in front of Bud Ford. He works the SEC beat for ESPN.
The blonde with the lazer voice who flips out in the second half is Heather Harrington – one of the local radio morning crew jockeys.
And the cameraman who was savvy enough to record the fight was an absolute saint. Great times.

But I don’t like this stunt at all. If you’re wanting to benefit off of the coattails of the BSU football team, then you ought not challenge them on their right to control their own press conferences. I say pull their press pass. Then they can cry all they want about first amendment. All the other local stations don’t have a problem complying with the groundrules for the pressers. BSU doesn’t want any more attention like this so I’m pretty sure this will blow over. Unless KTVB wants to continue to push it, then game on. Don’t mess with Kustra!

Clearly a planned stunt...
The e-mail regarding live broadcasts was sent three weeks ago. KTVB probably thought they had a legal right to air a press conference (and they might) and sent the new guy as their lackey. Listen to the uncut version. He is obviously nervous, but he has a few canned responses ready when they tell him to shut it down.
KTVB better be careful or they will be shut out or only given limited access going forward.
The best part of the whole thing was watching the responses from the other news guys on their twitter accounts. Not a lot of respect for KTVB among their peers.

I am glad I am not the only one that noticed the shoulder thing...
I can’t listen to what he is saying because I am so transfixed on his shoulder sway. I can’t figure it out. No quite a shimmy, not really a weeble wobble, but just a constants sway like he is secretly listening to a Otis Redding album.

Driving drunk could potentially injure others; whereas getting drunk w/o operating machinery just affects you (in general)

I enjoy driving down the road with my children on occasion. I have no problem with adults enjoying themselves responsibly, but be an adult and make the call for a cab if you find yourself drinking and responsible to get yourself home. How dare you get behind the wheel of a car, where you could potentially kill someone. For the record, I feel the same way about people texting and driving down the road. If YOU want to be an idiot (you in general, not personally kcam), go right ahead and do so, but don’t you dare endanger my family.
I’m not sure why the MJ thing rubbed me so wrong – it just did. I’m sure that he’s remorseful and heavens knows I’ve made my fair share of mistakes, I just take a hard line on someone who is obviously intelligent, articulate and with means driving under the influence. Same goes for the governor, as a matter of fact. Tried and true republican, but I leave the governor box unchecked on my ballot.

Broadcast rights, and the restrictions and limitations appurtenant thereto, are more in the realm of copyright law than 1st Amendment subject to regulation as to “public” airways.Boise State owns the content of its own press conferences. Once it allows KTVB to broadcast the conference, KTVB owns the broadcast rights to its production (you’ll see the disclaimer/notice at the end of KTVB’s show). Property law generally is introduced to the initiate law student under the time-honored analogy of a “bundle of sticks” i e “ownership” of a property as used in the common parlance means one has all the “sticks” and can apportion them as one chooses. In the instant case Boise State could sell the right to “live” coverage to XYZ Corp; in fact, movies are doen in precisely this way. The “first run” rights are sold to exhibitors (theater chains like Odeon); next in line are the “pay per view” tv channels, then premium cable on down to the networks. If Boise State wants to give its “stick” (live broadcast) away, it can. If not, tough. No 1st Amendment implication either case. Our online class is adjourned.
